Your lawyer is correct in

partial - if you use AP then you lose your H-4. If GC goes wrong, you lose everything.

You should try to get H-4 visa first. Usually there is no problem for that if you submit sufficent documents - 1.your hu*****and's employer's job verification letter to prove he is still under a valid H-1B status. 2. his most recent pay stubs at least three, 3. his H-1B approval notice. 4. marriage certificate.

If your H-4 visa application is turned down, you have no choice to use AP to enter the US.
