legally say you can not work during your case is pending. but if you don not want your company upset with this situation .you can tell them you can work as volunteer .If your company don not report to INS, I think you will be fine.If they want to pay you back after you get your h1b .that will be great .if they don not want to do that (if your company is a big company,most likely is hard for them to pay you back .they have to do lot of accounting job to make like that they are not paying you back .it just a bonus or compensation etc.)so now I think paying back or not paying back is not the most important thing .the most inportant thing is making the company satisfied. don not let them feel any inconvience because of your situation(you can not work for a certain time)
