About H4 use EAD

Just read some post qestions on fan-law.com. Dr fan said if a H4 used EAD(use it to work),he(she)will not lost the non-immigrant status.so the H4 still is in H4 status.If the pending I-485 is rejected.he(she)can still stay in USA legally.But I remember some body asked the same question couple of days ago.some one relied and said his lawyer said if you(H4, not the H1) used the EAD,you will lost your non-immigrant status. I am comfused which one is correct?
