i am in the same boat. Bascially it is a hole in the current regulation. I called the Immigration Department's customer service, they said no. However, I talked with a Chinese lawyer, he said we could try since the law doesn't explain it clearly and he also claimed that he has some successful cases. I'm not sure and haven't tried it yet.
