my NIW140 approved

in TSC. RD 02/04; RFE 12/04, response to RFE 02/05, AD 02/05

I'm now a PhD student and will graduate this summer. Could I still submit H1 visa application? I don't want to use EAD because it is said not safe to use it. thanks.
