In Form I539 Part 4 Question 3g, you will be asked to list your employment history in US. The immigrant office will notice this. If you used your EAD, then you have lost your nonimmigrant status. Whether to approve your H4 or not is totally his/her discretion. Theoretically, you can't get H4 status in US.
