You probably agree if you file 1040NR you have to file 8843 as well.

Now check pub. 519 page 7 under "Form 8843". Does H1 fall in any of the categories? If you can not exclude any days of presence, how can you pass the resident test?

Where did you find "non-profit" in pub. 519 for China?
