What I worry about is: if they don't approve the I765, does the applicant loss his/her H-1 status and so can not work any more here?
Answer:
according to my knowledge, as long as you concurrently filed 140 & 485, they will approve your I765 within certain months, which is not basing on either approval of 140 or 485.
( E.g.: concurrent filing on 02/02/2004; My 765 approved on 04/21/2004, while my 140 approved on 08/06/2004)
If you use 765 before your 485 being approved, which means you have quit the work status of non-immigration visa (H-1). I learned it when I renew my Driver's License in DMV.
While someone post a message today in this forum that if you does not change your employer (which is still your H-1 sponsor ), it would not affect your working status. Please double check with an attorney for this confusion.
