前言

本人從今年年初開始醞釀自己辦H1B，本周二收到移民局的notification of approval,期間曆時半年。開始是疑惑，猶豫，然後是準備工作的各種繁複，到今天變成了不吐不快，於是把自己在H1B DIY 過程中的體會和經驗貼出來，希望能對後來的同胞們有所幫助。

首先發一小店牢騷吧。其實痛苦準備的過程中，也不斷到未名和文學成的移民版上搜索 ， 但不知是不是自己太愚鈍，總之覺得有幫助的信息太少，很多的問題都是不著邊際，答案更是五花八門。推測可能大部分的人都聘請律師辦H1B，所以對這個過程也不甚了了。

在整個準備過程中，主要是兩個已經自己成功辦到HIB的朋友的幫助，在這裏先感謝他們，不過他們來不來這個版我都不得而知。

之所以貼出來，是覺得H1B的申請過程其實並不複雜，隻要耐心，細心準備，我敢擔保一定比律師辦得好！希望能對象我這樣工資不是很高，而又對移民律師持懷疑態度的留學生有所幫助。昨天無意中看了YIMINDIY的係列文章，覺得他寫的東西確實是真心話，不由得也考慮是不是請他幫忙DIY 綠卡。不過這是後話，現在這裏把自己H1B的經驗貼出來，也許會影響YIMINDIY的H1B客戶生意，不過，我的經驗隻適用於常規渠道的H1B,想來YIMINDIY 也有同感的。

言歸正傳，先介紹一下本人的背景，也就是本人所貼經驗的基本適用情況。

出國前就讀國內名校，工程專業，本科碩士花了8年。2001年來美，就讀同樣專業，今年年初碩士畢業，幸運地找到工作，先是OPT,然後轉H1B.

以上是本人認為最為常規的留學生申請H1B的情形，至於轉專業，曾經F2,H4之類的情況不了解，不過從我對I140表的解讀看，隻要申請材料準備齊全，應該與本人的申請方法相同 。

DIY的困惑

開始考慮辦H1的時候，也隻想到找一個律師就萬事大吉了。於是找來中文報紙和當地黃頁，挨個打了20多個律師樓的電話，發現都有個共同點：

1。中文報紙上的律師樓：接電話的是講中文的人，號稱秘書，自負的不得了，問及很多細節，都是“你要有誠意的話，來一趟，我們親自談。。。”。還有就是沒禮貌，跟國內那些官僚似的，好歹我也是個潛在客戶，碰到好幾次，都是他們說，你等等，我有另一個電話，然後都不把你HOLD，直接撂了電話去跟別人說，我聽見的無非是婦人饒舌，似乎不管業務的事。白人/西班牙人的律師樓更牛X的不得了，不提也罷。。。

2。從來沒有機會跟律師談過，唯一一次例外是那家律師樓的秘書號稱自己是剛來的，業務不熟，所以把電話直接給了律師。

3。把H1的申請複雜化，動不動問你有沒有“辦LABOR",有沒有雇主擔保之類的問題。對於前一個問題，其實他們是在混淆概念，在申請H1的第一步，有一個LABOR CONDITION APPLICATION的步驟，但他們讓你聽起來象是辦LABOR CERTIFICATION'似的，其實後者是勞工綠卡的第一關鍵/難題，而前者隻需要5分鍾就可以完成了。當然聽起來複雜的東西，就容易讓你心虛，自然更迷信律師了！

4。收費標準相差奇遠。我quote的價錢，從1000到3000，當然還附帶問了綠卡的事情，那收費就更是差的遠了，3000到6000。

跟10幾個秘書通話之後，我是對律師樓一點也不報好感了。最搞笑的有一個秘書，大口大氣告訴我：我們律師樓好幾個律師呢，信譽肯定沒問題。我問：那是那個律師負責辦H1的業務呀？他說：我呀！我奇怪：不是律師才能辦嗎？他答：哎呀，H1是最簡單不過的一個業務了，我們律師樓天天都有這類案子，我們都輕車熟路啦，就是我負責，沒錯！我問：可是你不是律師呀？他答：（很不耐煩）沒錯啦，這個業務全部是我負責，好啦，我還要講電話，你要有誠意就來一趟，再見！那個人的語氣跟口音，不騙你，就跟福建偷渡客似的。真讓人好不痛快，總覺得，花1000多刀，連起碼的客戶服務都沒有，一點也不專業！

剛好聽說有兩個朋友自己辦到了H1，於是電話過去谘詢了一通，決定自己辦，好歹也省不少錢。

搜集材料

這裏不廢話了，把自己搜集材料用的清單貼出來，你隻要把上麵的問題都找到答案，就可以開始填表了：

INFORMATION NEEDED FOR H-1B VISA APPLICATION

(1) Full name and address of employer.

(2) Address where employee will work if different from the above address.

(3) Address where documentation respecting employee will be kept if different from the above address.

(4) Employer’s telephone number.

(5) Employer’s fax number.

(6) Name and title of individual who will sign relevant forms and individual who should be contacted respecting visa application process.

(7) Email address of individual who will sign relevant forms and individual who should
be contacted respecting visa application process.

(8) Employer identification number (IRS tax number)

(9) Type of business of employer (please provide a company brochure if available)

(10) Year employer’s business was established.

(11) Current number of employees of employer.

(12) Employer’s gross annual income

(13) Employer’s net annual income

(14) Is the employee a new employee or an existing employee who is assuming a new position? If the employee is not new, give the most recent prior petition number for the employee and provide a copy of that petition.

(15) Has the employer ever filed an immigrant petition for the employee?

(16) Intended title of employee.

(17) Intended salary of employee (please also include benefits).

(18) Dates of intended employment.

(19) Provide a detailed description of the job duties.

其中需要雇主提供的信息有：（8）（9）（10）（11）（12）（13），其他的都是不言自

LCA

H1B 申請的第一步，是到聯邦勞工部去填一份叫做LABOR CONDITION APPLICATION的申請，目的是證明你的工資不低於當地同樣職業美國勞工的平均標準。也就是說，你從雇主那裏拿到的工資，要比這個平均水平高才行。申請通常在網上就能完成，你也能用傳統的郵寄或者傳真的方式提交。LCA的批準恢複時間，主要取決於你選擇的Prevailing Wage Source.

LCA 的申請表，叫做：ETA9035. 你可以到勞工部的網站下載，或者在線提交。網址如下：http://www.ows.doleta.gov/foreign/ 請詳細讀完網址中提供有關h1b的信息，你其實就對這個步驟有了非常詳細的了解了。

隻消仔細閱讀提供的instruction,完成這份申請也就是10分鍾的過程。不過要提醒你的是關於prevailing wage source的選取。填表中你會發現，有3種source: SESA,
Collective Bargaining Agreement, Other.

根據提供的說明，前兩種是guaranteed wage source, 也就是說，隻要你的工資參照標準來自於前兩種，那麽你提交的電子版申請不到1分鍾就能得到答複。我推測就是計算機係統直接進行判斷操作即可。但問題是，要去研究這兩種source中任何一種，如何索要表格 ，提交，等待答複，又是一個耗神耗時間的過程。我開始選擇用SESA,向本州勞工部索要了prevailing wage的征詢表格，填表，還附上一個詳細的job description,交上去等了20天，可拿回來一看，他們給我定的工資水平比我的高2完！看來我在job description中填的太細，讓那些不懂行的勞工部官員看上去太高級了。

於是決定選擇online application form 中提供的“online wage library" 連接，自
己找到了與我職位相稱的工資標準。但要注意的事，這個source不屬於前兩種guaranteed source, 請見：http://www.ows.doleta.gov/foreign/wages.asp#4中有：The OES （Occupational Employment Statistics survey ） is a national survey managed
by the Bureau of Labor Statistics (BLS), which provides a large enough sample
to allow BLS to determine a prevailing wage for every occupation in every area
of intended employment in the United States. 所以說，你應該在wage source一欄中
填 “other",然後給出名字：BLS-Occupational Employment Statistics survey. 這麽填
的不同在於，你提交的申請需要有勞工部的人來審核，因為計算機係統中隻有前兩種默認的 ，guaranteed的source, 所有其它的source都要有人工來審核，其實也就跟郵件/傳真提交一樣了。

你肯定擔心，哎呀，這不是有風險麽，不是guaranteed wage source呀！別怕，你用的是他網上提供的參考，雖然落入“other"的範疇，但這個BLS-Occupational Employment Statistics survey肯定是沒問題的，勞工部的人也就是看一眼，就給你批了！

抱歉，好幾天沒寫了。

言歸正傳.

辦完LCA後，就可以到INS的網站去下載相關的表格填了。如果你不需要辦加急，也就是PREMIUM PROCESSING SERVICE,那麽你隻需要填好FORM
I-129, FORM I-129W即可；如果需要加急，那麽再把FORM I-907也一塊填好。下在表格的網址：http://www.immigration.gov/graphics/formsfee/forms/index.htm

請務必仔細閱讀表格所附INSTRUCTION,我記得自己好像讀了四，五遍，然後你就會對填表中的一些細節胸有成竹了。每個人的情況不同，但基本的問題就那麽幾個，隻要搜集完整了我前麵提供的那些問題的答案，照著填，應該不難的。填表應該以公司的名義進行，也就是說，你要站在將來為你的表格簽字的公司有關負責人的角度，把公司，你自己，以及有關的職位的情況填進去。有一點需要強調的是，一定要給自己準備一個如實，簡潔但又說明問題的JOB DESCRIPTION,因為FORM I-129 的H SUPPLIMENT 需要提供這個DESCRIPTION. 我的做法就是把JOB DESCRIPTION寫好，用公司的LETTER HEAD打出來，附在那個H SUPPLIMENT後麵，當然要在表格中的相應位置填：SEE ATTACHED
PAPER (想必辦過出國申請的同學們都知道怎麽填的，如何整理表格就不多說了）。

填好表格後，下一步需要寫一封PETITION LETTER.

Petition Letter

所謂PETITION LETTER,就是把整個申請中的有關信息總結性地重複一下，寫成一封給審批的官員的信，大致份4部分：

1。信頭：

Case Type: I-129H Petition for a Nonimmigrant Worker (H-1B1 Visa)

We are writing to submit an H-1B1 petition on behalf of XXX (your name), so
that he can work in our firm as a XXX (your title). The H-1B1 position is
scheduled to begin on XXXX （date), and to terminate on or before XXXX (date
of 3 years later). Mr. XXX will be paid an annual salary of $XXXX.

2。有關公司的信息總結
Information about XXXXX (name of your company):

In less than 15 rows, summarize the following info:
1. When was the company founded
2. What's the Federal Tax ID
3. What's the address of the principal office
4. What's the address of the office you're gonna work in, if different from 3.
5. How many employees currently?
6. What's the most current annual gross income/revenue of the company (optional, not necessary if your employer doesn't want you to know)
7. What kind of service is your company providing? i.e. the nature of your business.

3. Description of the Position Offered (Just copy the JOB DESCIRPTION you prepared for the I-129 H Supplement. But
DO NOT make it too long and to complicated to read).

4.Mr. XXXXXXX’s Qualifications
Summarize your qualifications, such as what kind of degree, what kind of exprerience you've had, etc. You know how to make it sounds like your are the best match, right?

AGAIN, DO NOT MAKE IT TOO LONG. THIS IS JUST A SUMMARY, NOT A PERSONAL STATEMENT！

寄出材料

在你確認你要寄出材料之前，請確認所有的文件都仔細檢查過，簽過字，相互之間沒有不一致的地方。然後，請按順序準備如下東西：

這裏附上我寄給INS的LIST OF DOCUMENTATIONS:

1. Payment of the Fee:
• Company Check (or money order) #xxxx: $1,130.00 for I-129
• Company Check (or money order) #xxxx: $1,000.00 for I-907
2. Application Forms:
• Form I-129.
• H Classification Supplement w/ one-page attachment.
• Form I-129W.
• Form I-907.
• Certified Labor Condition Application – ETA 9035.
3. Supportive Evidence:
• Copy of Alien’s Passport.
• Copy of Alien’s I-94.
• Copy of Alien’s current visa.
• Copy of Alien’s Social Security Card.
• Copy of Alien’s original I-20 issued prior to SEVIS entry.
• Copy of Alien’s updated I-20 issued for Post-completion OPT after SEVIS entry.
• Copy of Alien’s EAD Card, expired upon (your EAD expired date).
• Copy of Alien’s I-765 Notice of Action, for OPT extension.
• Copy of Alien’s US Master’s degree and transcript issued by XXXX (name of
your university).
• Copy of the employment letter issued to the Alien by XXXX (your company)
• Copy of Alien’s Resume.

我使用FEDEX寄的，沒有加快，就是普通的那種，但使用了他們的“notification of
delivery" 服務，具體名字我不清楚，因為是公司秘書幫寄的，第三天就收到了fedex 的確認。一周後收到INS的approval email.

後記

以上是我自己辦H1B的全部過程和自認為比較重要的心得總結，僅供想要自己辦H1B的同胞參考，其適用條件基本是“留學--OPT--H1B",期間沒有轉專業，沒有轉學。不過，我給INS提交的僅僅是在美國獲得的學位，所以，理論上說，隻要你這個學位與職位匹配，就應該不受轉校或者轉專業的限製，至於其他的情況，請自行斟酌。

整個過程中比較重要的文件，是job description 和petition letter，換做是律師，
其中的關鍵信息也都要是你自己準備的，她不過就是給你把他們穿在一起而已。對於那些還猶豫要不要找律師的同誌，不妨參照我給的步驟自己先準備一遍，就算是熟悉情況，也就一個禮拜的時間吧，等到最後是在覺得自己不放心，想要找一個律師，那麽這些材料也是你需要提供的，不算是白費功夫。

答疑

Ever since I posted my experience in H1B DIY, I got couple of email asking questions. Here I post one of the most representative one, in case there is anything I didn't explain clearly.

Once again, before asking questions, please read through the instruction of I-129 carefully, and the FAQ links on the website of Dept. of Labor, regarding
LCA and H1B.

Ok, here is my answers to some of the questions:

Sample Questions

1，一開始的lca， 你是在網上直接申請的，哪多久得到的回複呢？回複是什麽樣的？傳真， 還是郵件？如果是傳真， 你是留的公司的傳真號碼麽？聯係人是你自己， 還是公司人事部門的什麽人？

2， 申請表格中有很多地方是要公司人事部門的人簽字的，你是自己填好了， 然後
請他們簽的麽？

3， 在寄出材料的時候，寄信人的地址是你， 還應該是公司人事部某人？

4，自己辦理， 如何能拿到receipt notice and application number? 應該寫誰的
地址 ？

5，材料寄出之後， 等著就可以了？

6，請問你是在哪個中心辦的，如果是vermont， 應該寄到哪裏呢？

7，money order必須是公司的麽？公司的支票， 行嗎？ 我是自己付。

Answers

1. LCA - I did it online. Everything goes electronically. After I chose "Other: OES" for the wage source and submit it, I was linked to a page
saying that the LCA needs be reviewed by an officer. At the same time, I can
download the pending LCA in the format of pdf. Just save this file for your record.
You should get the approved LCA in about 2 weeks. It's also a pdf file, sent to the email address you provided in the application form.

2. Contact - Since I did this online, I used my business email address, i.e.
the "[e-mail]". DO NOT use hotmail, aol account. Imagine how
could a company file a petition using a public email server address?

3. Contact, again - Yes, everything must be in the name of the company. If
you read throught the instruction of I-129 carefully, you will know that the
petitioner is the company. So, when you prepare the documents, you should
think you are the HR person in your company filling a form for one of your
employee. So, everything, except the email address, must be your company's.
As to the ATTN name, you could put "your name c/o name of whoever takes charge
in your company", example, "bballfan c/o George Bush" say, George Bush is the
man who will represent the company to sign my forms and fill the petition on
behalf of me :-P
