Yes, if you ask a lawyer, you will find that you've been out of status for 1 year. The BCIS will treat the 1st time you got the rejection as the start time.
For 1 year out of status, there is 3-5 year bar, meaning that you cannot get visa to enter U.S. for a few years. If you stay in US longer out of status, and get no possitive result from the law suit, you cannot enter U.S. for 10 years or even longer.
One risky way is to go back your own country, and apply visa again. I have a friend who've been out of status when transferring school still got visa in Shanghai.
