ask a favor

I would appreciate it if someone could clarify one thing for me.

My OPT will expire on Feb 9 2005, but my H4 visa won't be approved before that date
because I submitted the application to Nebraska center on Oct 28 2004. It will
take more than 4 months to process. Is it legal if I
stay in US after Feb 9 2005 (and before my H4 approved)?
