Right now, Chart B is current in September, so we could file I-485/I-765/I-131. But Chart A is still way behind. My understanding is that if the I-130 takes longer to be approved, that gives us more “pending time” for CSPA protection. On the other hand, if it gets approved quickly but Chart A doesn’t move fast, we could age out.
I’ve seen F2A I-130 approvals take anywhere from under 12 months to as long as three years (for NVC Consular processing maybe?).
If we file the adjustment now, would that make USCIS review the I-130 faster (which might not help us)?
-No. Your kid's I-485 filing is irrelevant to your I-130 processing, i.e., it does not make the I-130 approved faster or slower whether your kid files I-485 or not.
Or is it safer just to go ahead and file now to lock things in?
-Yes. I suggest your kid to file I-485 now. Then, your kid's CSPA age will be frozen when the priority date is current based on A Form.
