If the person overstay in US for > 6 - months or one year, the person will be subjected to 3-year or 10-year bar to reenter US after he/she leaves US. If the person is in US, or reentered US already in US, the bar is not applied to him/her, but his/her I-485 may not be approved unless he/she is a immediate relative of a US citizen.
