又要麻煩您了。長話短說：我曾有過removal proceedings 但後被移民法庭closed。 我的雇主在遞交I-485 時， 沒有把移民法庭的決定文件一起遞交。 大概三年前，USCIS 來信讓我補交移民法庭的決定文件，他們收到補交的文件後， 在他們的網站上說已收到我的RFE並又開始著手處理我的案件。沒想到在我renew EAD 時， 被告知我的case 已關閉，EAD 申請被拒。 要我申請I-290B 以便re-open 我的案件，並要遞交移民法庭的決定文件。 我照做了。等待回複的時間很長。 因擔心信寄丟了， 於是我又遞交了一份I-290B。 誰想第二次寄出I-290B 沒幾天，便收到了批準啟動的來信及新的EAD。 看到我的案件又重新開始， 我就把隨第二次I-290B form的銀行支票取消了。 然後收到一封來自同一個人的拒絕信。
8老師，我的EAD又要更新了，我應該怎麽辦？ 我需要再重新申請I-290B 嗎？迫切希望得到您的回複。
-Check with USCIS to see whether the denied I-290B is your first I-290B or your second I-290B which was denied due to your cancelled the payment fee.
If it was your first I-290B denied, what is the denial reasons? You may file a new I-290B Motion to reopen he case or a motion to reconsider the decision. But the new I-290B should be based on documentary evidence of new facts.
“New facts” means facts that have not been previously submitted in the proceeding. Reasserting previously stated facts or resubmitting previously provided evidence does not constitute “new facts.” Also, the new facts must be relevant to the issues raised on motion.
