我是綠卡持有者，現在準備幫身在海外的家屬（新加坡籍）申請婚姻綠卡。家屬正在走B2的流程，預計9月初會和我一起回美。我們是21年在麻省結婚的，有美國的marriage certificate。

現有幾個問題想請教8老師：

1. 家屬本身因國籍是新加坡，本不需要簽證來美，但通過visa waiver program (VWP) 隻可以呆90天，而申請B2則可以呆180天。B2是否是最好的暫時留美的方法？不知道通過VWP入境，是否也可以走I-130的申請？

-You can file I-130 90 days after he entered US using VWP or B2 visa. The problem is that he cannot file I-485 if he uses VWP to enter US. So, he had better apply for B2 visa in the US Consulate  and use it to enter US.

2. 在他入境之後，是否還需要等待3個月才可以申請I-130?

-Yes.

我可以同時申請I-485嗎？

-Depends on whether the I-130 priority date is current. If it is current at that time, then he can file I-485. So, check the Visa Bulletin at this link when you file I-130:

還是說這個隻是針對美國公民的婚綠申請，我自己隻有綠卡，必須等他I-130 approval以後才能I-485?

-Not really. See above.

3. 如上述方法可行，在他呆滿B2的180天之後，必須離境，這個會影響婚綠申請嗎？有什麽辦法可以繼續留美，等待I-130 approval呢？

-If the I-130 priority date is not current within 180 days, he needs to leave US and apply for the immigrant visa in Singapore.
