我現在所持有的綠卡是有條件婚姻綠卡，我的妻子幫我申請。綠卡下來之後的兩年中兩個人性格不合逐漸明顯出來，也嚐試努力過，最終還是很難走下去。每次生氣她就直拿綠卡給我說事，總是覺得被她拿一把的樣子，我現在有想請我的公司幫我申請綠卡，這樣她也不會再拿這個事情不停的要挾我。目前這還隻是一個想法，不太清楚如果這樣去做後果會是什麽，需要多久可以呢？（假設公司可以幫助申請的前提下，類別應該是eb3）
-First, your marriage has lasted for about two years which can prove your marriage is true, you should have no problem to get the permanent green card even if you get divorced. You can file I-751 by yourself for waiver if you get divorced. As long as your marriage is true marriage, divorce does not affect your I-751 waiver application approval. Hire a lawyer to help you out.
Second, if you want to apply for the green card again using employment-based category, you need to abandon your conditional green card first, then you need to go to China to get the H-1 visa to come back because after you abandon the green card, you do not have a status to stay in US immediately. Then, the employer can sponsor your green card. EB3 takes about 5 years. Also, it is difficult to get the H-1 quote.
So, my suggestion to you is that you may try to discuss with your wife to keep your marriage. But if you absolutetly cannot keep your marriage and get dirvorce finally, then you may hire a lawyer to help you to file I-751 for waiver by yourself.
