8老師您好！我的NIW based 的 I485是2021年11月提交的，兩周前收到RFE需要新的693，下周將寄出新的693。我2019年11月曾經去485綠卡麵試，USCIS因我在當年夏天回國給否了（其實我的第一次485所linked的EB1b被拒了，485應該要被據掉的）。

1. 我的O1簽證2月11日過期，可是我現在沒有EAD, 也不能再續簽O1, 請教在等待綠卡期間為保持合法身份，我需要做什麽？

-Your status will be Adjustment of Status after the O-1 expires, so you don't have a problem to stay in US, but you cannot work in this case unless you have EAD..

2. 我想拿到綠卡後就先回國一段時間，所以還沒有跟雇主談繼續工作的問題。2月11日之後，我可以失業在家等綠卡嗎？還是最好繼續為雇主工作，以免485因失業被拒？

-I would sugest you to extend the O-1 and continue to work for the employer until you get the green card in case USCIS ask for your employment status before they approve your I-485. Of course, if you have EAD to work, then you do not have to extend your O-1 status.

3. 我在2021年9月提交了485+131+765，131+765 兩周後就接到收到通知，但是485因為申請費弄錯了兩次一直到11月底才被接受，12月底通知以前做的Biometrics 仍有效，不必再做。我的綠卡不知啥時能獲批，請問我的131 AP有可能在綠卡拿到之前獲批-嗎？

-Yes.

如果綠卡還需要8、9個月甚至更長時間才能拿到的，我想5月份回國，可否申請加急AP?

-Yes. You can call USCIS to make an appointment with the local USCXIS Field Office to apply for the emergecy AP. Prepare the justtification on why you need to travel urgently.
