我父母2019年中持B1/2簽證來美探親，入境時拿到六個月的居留許可。期間我遞交了I-130表為他們申請父母移民。2019年10月收到I-797 Notice of Action，移民申請得到批準並指導我們可以遞交I-485在美轉移民身份。可是我父母改變主意了，決定不移民了，想過完2020年春節就回國。所以他們就沒有交I-485。結果疫情爆發，他們回國的飛機兩度被取消，他們便一直滯留在美國。我沒有給他們辦過簽證延期，因為有I-797, 並且I-797上並未有action的時間限製(deadline)

-That I-797 approval notice for I-130 has noting to do with their legal stay in US. 

。請問他們現在在美國的居留是合法的嗎？

-No. Their unlawful presence (i.e. illegal stay) has been more than one year and that means if they leave US, they will be subjected to 10-year bar, i.e. they cannot enter US within 10 years. The only way for them to solve this problem is that they file I-485 to get the green card within US. Then, they can give up the green card later if they don't want to stay in US permanently. Then, they can apply for B2 visa again to visit youu after they give up the green card.

他們已經買到了10月底回國的機票了，發現申請申請回國的健康碼需要提供“在美合法居留文件”。請問他們可以用入境美國的簽證（現已過期）加上I-797作為合法居留文件嗎？

領事館對此項要求到底嚴不嚴呢？他們關鍵是看什麽呢？
