8老師您好！我的2018年7月遞交的NIW兩年前獲批，現在485排期到了。我目前在美國是O1簽證，2022年2月到期。我計劃今年年底回國工作兩三年年，但也可能還要明年夏天回國。
1. 請教我這種情況，是等今年底回國後再從境外申請485, 還是現在就申請 485 + Advance Parole?
-You cannot file I-485 when you are present outside US. You had better file I-485 now and apply for advance parole at the same time and use AP to travel.
如果綠卡要一年才下來，我中間又離境，那我的485就作廢了 （我曾經和EB1一起遞交過485，2019年底還去移民局麵試和交體檢表了，但因那年夏天離境被否了）
-If you use AP to travel, the I-485 will not be denied.
2. 因為我也有可能要明年夏天才回國，我是不是在遞交485時也要提交O1延期？還是遞交了485後，就可以合法居留直到拿到綠卡，不需要O1了？
-You don't have to extend O1, but you need to have EAD to work. So, you had better apply for the EAD at the same time when you file I-485. The problem is that if your O1 expired before you get the EAD, then you must stop working. In these days, it takes a long time for EAD to be approved due to Covid 19. So, you may consider extending your O1.
3. 485排期到了之後，最多可以拖延多久file 485而不影響最終獲得綠卡？
-You must file I-485 within one year from the date your priority date is current. Otherwise, your I-140 may be revoked.
