8老師， 您好！

我弟弟2019年底申請綠卡麵試，我侄兒同時申請了未成年子女同行，他太太沒有申請。原本希望2020年能夠麵試。由於疫情發生，簽證麵試停止，現在還沒有接到通知。我侄兒現在過了21歲，

-Based on the CSPA, your nephew may be still qualified for the immigrant benefits as his father's derivative. Calculate the CSPA age as follows:

The child's CSPA age = his actual age when the I-130 priority date is current (排期倒時的年齡）- I-30 pending days

Note: I-130 pending days = I-130 approval date (i.e. the I-130 aprpoval notice issued date) - I-130 receipt date

You can find the I-130 approval date and receipt date from the I-130 Approval Notice.

If the child's CSPA age is < 21, then the child is not age-out, thus he can apply for the immigrant visa with his father and come to US to become a green card holder.

因此就把他從麵試申請上去掉了。現在他準備申請留學簽證。申請表上需要填寫是否申請過移民。請問-

1》 可以填NO嗎？ 領事館是否可以查到他的記錄嗎？

-Did he file DS 260 application for the immigrant visa yet? If yes, then the record will be in the system. If no, just say "No" to this question.

2》如果填Yes, 對他的留學簽證有多大的影響？

-Probably it will affect the F1 visa application.

這種情況如何向簽證官解釋比較合理？

-It is hard, but just try to convince the VO that he will return to China after completing the study.
