背景:今年公司不景氣,工作部分移到了印度,要雷掉我,但因為我是H1B,直接老板考慮到我的情況在一直幫我拖延(最多應該可以拖到12月中),同時我也在積極找工作(目前看來問題不大)。

昨天,10月2號,收到律師通知Perm批了,我的 priority day 是2016年8月3日。我馬上和老板聯係了,她詢問了HR, 說如果我自己出費用的話,公司可以繼續幫我遞交剩下的材料,我走後應該也不會撤銷140。

現在B表EB2 2016年10月1號,我可以同時遞交I40和485。目前看遞表後,我是肯定不會在現在公司呆滿180天了。

問題:

1. 如果I40和485很快都交上去了,新工作我是應該用H1B transfer還是EAD(假設換工作時加快EAD已批)?

-You had better do H-1 transfer, espcially you change of job before your I-485 pending is less than 180 days and before your I-140 is approved.

2. 如果用H1B,移民局是不是會知道我在485pending 少於180天就換工作了,從而拒掉485?

-USCIS will know you change job before your I-485 pending is less than 180 days no matter whether you do H-1 transfer or not.

3. 無論用H1B或者EAD,如果485需要補材料而我已經離開現在的公司了,怎麽辦?

會不會考慮疫情原因法外開恩,好像新公司也可以用一個J表給予幫助?

-Yes, the new employer can provide 1-485 J, but your problem is that your I-140 is not approved yet before you change job and also, your I-485 pending is less than 180 days.

4. 看目前形勢,我馬上就current 了,如果麵試時485還是少於180天,而我又去新工作了,會不會馬上被拒?

-It is possible your I-140 or I-485 will be denied in this case. But normally the interview probably may not take place so soon and hope it may occur after your I-485 pending is more than 180 days. The serious problem in your case is that USCIS may send your current employer the RFE for the I-140 case before the I-140 approval, so you had better discuss with your lawyer whether the employer can respond to USCIS (if receive RFE) that they agree to hire you back after you get the greeen card and thus, continue to sponsor you (i.e. support the I-140).

據說現在因為疫情,好多麵試都取消了,處理進度也特別快;很可能我沒有麵試就直接過了。
