我是30多年前來的美國早已入美國籍。離開中國時辦理了我自己的出生公證書。中文公證書有紅印章，有鋼印。但是我隻有一份原件。公證書自帶中文原件和公證處的英文翻譯。公證書的英文也有鋼印但是沒有紅印章。

 

2012年我給我妹妹申請了綠卡。

 

最近收到移民局來信，Request for Evidence. 說我本人的出生證does not meet country requirements. 

 

我妹妹的出生公證是新的格式帶身份證號碼等，移民局沒說她的出生證要補充啥。就是說我自己的出生證要補充一大堆東西。

 

請問： 

1。 我拿我自己的出生公證書原件在美國當地找一個懂中英文的公證員給公證一下就行了？

-It will not work.

 

用找移民律師嗎？我的出生公證書原件帶鋼印和紅印章的我隻有一份，移民局是想要我出生公證的原件嗎？彩色複印件加上美國這邊的再次公證就夠了？

-It seems your 出生公證書 did not follow the USCIS requirements which require the translator needs to have a statement addressing that he/she knows both English and Chinese well and the translation is accurate. If you have the original birth certificate (e.g. from the hospital-most Chinese don't have it), not出生公證書原件,  then you can ask your freind to translate it into English follwoing the USCIS requirements. If you don't have the original birth certificate, then You had better do 出生公證書 again in China.  Most formal 公證 agency in China know the USCIS requirements very well today.

 

By the way, USCIS do not require公證書原件 and the photocopy is enough.

2。 我用在中國再重新辦一下我的出生公證嗎？太麻了可能也來不及了。-Yes, do it and then scan and email to you. Then, just print it out using color printer.

 

3。2012年我父母都還健在。這幾年陸續過世了。還要附上我父母的死亡證明？-Not need. 也得公證？-Not need.

 

3。 30多年前來美國的中國人給親屬辦綠卡還在排隊的都被移民局要求補充出生公證？還是就是我自己？
