背景： H1B 第一個6年已經用完， EB2/I140 已經去年 approved。現在的公司已經幫忙辦理了新的H1B 延期（2019/8-2022/8）。 8月activated 後工作到現在。12月計劃離開現在的公司，回去中國的公司工作。
8老師之前幫忙解答過，H1B延期approve 後，工作一段時間， 離職後再返回美國可以不需要新的H1B quote， 現在的問題是：有沒有什麽時間， 或者其他限製 繼續使用原來的H1B。
-Yes, there is time limit. If your prority date is current and you don't file I-485 or apply for the immigrant visa within one year, the I-140 approval will be revoked and thus, you cannot use it to apply for the H-1 extension beyond the 6-year limit.

1.是否需要在2022／8月之前到美國，並且新公司需要在2022/8月之前submit H1B 申請？-Not need.因為當前延期是到2022/8 截止。 如果2022/8月之後submit H1B申請， 是否需要新的H1B quote。-No unless your I-140 is revoked because you don't file I-485 r apply for the immigrant visa. See above.
2 .新公司做H1B申請，是申請使用原來的H1B quoto, 這個申請還是有被移民局refer 或是refuse 的風險嗎,假設公司，職務都沒問題， 隻是不allow previous quoto
-No problem. You can use the approved I-140 to apply for the H-1 by the new employer if the I-140 is not revoked yet (see above).
3. 12月離開現在的公司， 現在的h1B extension 多久失效？家屬的H4 EAD 卡還能用多久？-When you leave US and not come back, your H-1 and your spouse's H-4 status will be void at the date you leave, i.e. your whole family need to leave US at the same time if you want to work in China.
