老師您好！我2018年2月遞了Eb1的140+485+ AP +EAD, 3月去USCIS采集了biometrics; 6月收到了AP+EAD, 但是都沒用；7月遞了NIW和O1, O1去年底批了。今年1月Eb1拒了，但是NIW的140批了，收到的USCIS 797上寫的PD是2018年2月，而不是遞交NIW的7月。今天收到了移民局的電郵關於我的485的通知“Case Was Received At My Local Office”。這樣看來，我的485是否沒有因為Eb1b被拒而失效了，而是隨著NIW的批準還有效呢？我已經定了6月初暑假回國兩個月的機票準備申請O1回來。我的Advance Parole是今年6/1過期，現在申請renew Advance Parole也來不及了吧？怎麽辦呢？我應該打電話給移民局問485到底是會被拒還是有效嗎？懇求8老師指點。萬分感謝
-The I-485 will be denied sooner or later because the EB1 I-140 was denied and NIW I-140 priority date is not currnet. But you still can use advance parole to travel before the I-485 is denied. You can go to the local USCIS Office to apply for emergency advance parole if you want to. Otherwise, you may apply for O-1 visa to come back, but this means you abandon your pending I-485.
By the way, if you use AP to travel, you will lose your O-1 status, and thus you have to use EAD to work, not O-1 status.
