The quotes were based on the infamous 2000 published INS announcement, which is confusing and causes debates over the years. BCIS in 2003 and USCIS in 2004 issues memo to clear this to H/L/O/P status holders' favor, but they are memo, which are internal instructions from a higher ranking officer, can be changed and rejected and withdrawn anytime by a new memo. They are not published rules.
