本人H1b, EB3, Pd 8/2015. 孩子目前大學四年級，今年五月畢業，已收到某大學博士研究生錄取通知書。孩子一月份已21歲，從而h4 , I94 過期。去年10月遞交H4 to F1轉換身份申請。從目前處理速度來看，五月份之前不一定能處理到他的申請, 學校要不斷推遲他 I20 上的 program "start date" 。學校給出兩條建議：1）file "B2 visa Application" to bridge the gap between his previous H4 status and the time when his F1 approves, therefore to make sure he has a legal status 30 days before your new F-1 program start date.  2) 出境辦簽證

我覺得第一條不可行， 因為一旦申請b2,他就不能繼續讀書，按期畢業了。可是他又沒法延h4, 不能滿足f1開始之前30天有合法身份的要求 (http://www.nafsa.org/Professional_Resources/Browse_by_Interest/International_Students_and_Scholars/USCIS_Policy_on_Filing_Bridge_Applications_During_COS_to_F-1_or_M-1_Status/?,  沒什麽辦法，隻能眼睜睜的等著f1申請被拒

如果實在需要出去辦簽證，簽證有風險，-Has he filed I-485 yet? If no, It should be fine because your I-140 is irrelevant to him (he can say "No" to the question like whether he has immigrant application or someone filed immigrant petition for him).

-This is better. He is lawfully present in US at present (during the change of status application lending). His school needs to issue a new I-20 to him for application for F-1 visa outside US. He can only enter US in advance up to 30 days before the I-20 effective date (i.e. the school new semester start date).

他的這種情況 ，可以去加拿大簽嗎？_I am not sure. You need to check the US Consulate website in Canada,
