H1 to H4 -layoff then H1?

I held H1-B visa but I got layoff on Oct 29, 2004. Since my 485 pending (my EAD expired and I did not renew), I file petition for H4 in Nov. Maybe I did it wrong I should not transfer back to H4. My quesitons are (1) if someone want to hire me now, can they still file H1-B visa and I can work without wait for H1-B approval? As H4 is still in process. (2) If H4 does get aproval, can I start to work without waiting for H1-B approval if the future employer can file H1-B petition? (I just file EAD and expected to get in early Feb. next year according to current process date). Could anyone provide suggestion?
