我朋友去年140和485一起交的，他也使用了EAD和AP。最近他收到140RFE,他怕140 被拒失去身份，所以想申請O1。
1. 485pending期間他可以申請O1嗎？
-Because he has no legal non-immigrant status after he used EAD to work, he cannot change status to O-1 within US.
2. 隻要在140悲劇之前交O1 的申請就可以吧？配偶和孩子也是AOS身份，能交I-539轉O3嗎？

3. 如果當前140悲劇，可以在O1 pending 期間交新的140和485嗎？
-Technically yes for I-140, but no for I-485 because he has no valid non-immigrant status.
4. 如果140 悲劇，他還沒來得及交O1，是不是他就隻能回國？
-He has to leave US after the I-485 is denied.
5. 如果140 被拒，他回國後可不可以在國內的領事館申請O1簽證呀？
-Yes.
會不會說他有移民傾向呀？
-No problem because practically O-1 visa/status is considered as dual intent (i.e. allow to have immigrant intent, similar to H-1/L-1). But if he leaves US to get the O-1 visa during the I-485 pending, then his I-485 will be invalid.
If his I-485 is denied, he can go to China to get the O-1 visa to come back.
