紐約的一個律師說的情況和AKC回複的一樣,就是學校開學在6月20日,我的身份轉換最早提前30天,就是5月21日,當我的L2身份隻能到5月9日,就有一個GAP出現了,USCIS可以否決我的轉換要求,但是那個律師說L2的60天寬限期是存在的,因為有客戶這樣辦理過,我從不同律師地方,得到不同的解釋,所以想知道為什麽L2是沒有寬限期的,2017年1月17日的法案不是明確了可以有60天寬限期嗎?
-You are right. You have the grace period of 60 days based on the new rule. I just forgot the new rule which was effective in January 17, 2017. By the way, if you file your I-539 before your L-2 I-94 expires, you are legal to stay, and wait for the change of status approval. If the F-1 is approved after May 20 or later, then you are not considered to have unlawfyl presence and can continue to study. So, you are very safe!

-I-526 is related to your spouse only, not you! You only get the benefit to file your I-485 based on your spouse's I-485 in the future. Before you file I-485, nothing will be related to you.
