我背景：離異，兒子美國公民在上大學，今年6月滿21歲如果為我申請綠卡，麵臨以下幾個問題
1，資金擔保，兒子沒收入，如果我贈送給他10萬是否可以作為擔保？

2，可以讓我妹妹妹夫提供擔保（他們是大學教授收入應該沒問題），他們是和我兒子作共同擔保人？還是獨立擔保我？

3，我現在10年b簽證，如果我在美國內申請，有人說要入境3個月後再申請，有這個說法嗎？
-No lawyer requires that, but practically yes in case USCIS consider that you have the immigrant intent before you enter US (B-2 visa fraud).
4，如果在美國申請，同時遞交申請和回美證申請，回美證多久能批下來？
-About 3 months. You may go to the local USCIS Office to apply for emergency advance parole if you have the reason to prove that it is urgent for you to leave.
國內還有工作不能長時間離開
5，如果美國境內申請到回美證下來時間太久就隻能考慮在中國等了，在國內等的這一兩年期間我b簽證是不是就作廢了？
-After you file immigant application, you will not be allowed to use B-2 visa to enter US.
如果持b簽證硬闖，被原機遣返的幾率有多大？
-Very big and if you are denied to enter US, you might have unexpected trouble.
我父母快80了，現在每年回美國看他們兩趟，如果一兩年不能入境還真不放心
再補充一個問題，關於兒子給我申請所需要的材料
早在06年沒離婚時候申請過全家綠卡，140批準後等485期間因為離婚就沒再繼續，所以移民局原來那個case裏有家庭關係等所有文件，這次申請是否還需要重新作材料
