A公司： terminated on the end of July；
B公司: H1B transfer filed on the first week of August, still waiting for the result. And start to work at B after H1B was filed.
C公司: Due to family reason, would like to go to C. Then C can start H1B transfer at the end of August.
- C公司的H1B transfer 能否從 A transfer 到C?-Yes, but probably the approval may have no I-94, especailly if the Company A withdrew the original H-1. If so, your spouse needs to go to China to get the H-1 visa to come back. A-C transfer 對正在進行中的B-C transfer 會不會有影響？-No.
- 如果A-B 和A-C 都被approve，是不是就有了兩個h1b? 哪個會是有效的h1b?-Depends on which company your spouse will work.
- 如果A-B 被approve with I94, A到C被approve without I94 或者 rejected， 是否會影響被approve的h1b?-No. Your LD still can work for Company B or go to China to get the H-1 visa to come back to work for Company C if the approval hsa no I-94 from A to C.
- 如果C公司的transfer 是從B到C， 是否應該等到A-C的完成？短時間之內能否進行兩次transfer？--Only one H-1 transfer petition can be filed by C (either A to C or B to C). 會不會留下bad record, 影響綠卡的申請？-No, but Company B will not be happy. 能有什麽補救措施嗎 -If you want to transfer from B to C, then you need to wait for A to B approval.
