Although it supposed to be limited by Cap, but tell you the truth, it is not always correct. I have my H1B firstly approved in early 2002, for non-profit University. This year I transferred to company, and applied the extension for profit org in mid Sept, starting date is sometime before Oct 1. Surprisingly the case has been approved. So I am als confused. Ask a immigration attorney may give you the most accurate answer.
