8老師您好, 我的詳情可見以前我的帖子, 簡單地說, 就是有過arrest record by discordly conduct, 但檢方在我完成Deferred Prosecution Program後已正式發函告之:

"You were not charged in criminal court. Due to your successful completion (of DPP), the chare against you will not be prosecuted and you have no criminal conviction."

現在在我們I485申請(用的我老婆的EB2. 因為問的好幾個律師都不太想接our case, 所以沒請律師)提交後一年後(我也用EAD找了份比較滿意的工作), 終於等來了麵試通知, 估計是arrest record的事情或別的材料需要麵談.

現正在準備麵試的事情, 基本材料按麵試通知的checklist已經準備好, 隻有如下一件事情想問一下8老師:

1. The checklist in the interview notice contains:

A completed Affidavit(s) of Support (Form I-864) with all required evidence, including the following, for each of your sponsors (unless already submitted):

• Federal Income Tax returns and W-2's, or certified IRS printouts, for the most recent tax year;
• Letters from each current employer, verifying current rate of pay and average weekly hours, and pay stubs for the past 2 hours

a. 但我發現I-864主要是對Family-Based Petition, 我太太的肯定不算, 我的算不算?

-Not need I-864 for both of you. Explain it to the IO that your I-485 is EB category.

b. 我記得我在遞交我們的I-485時, 根本就沒交I-864. 現在我需要補一個嗎?

c. 至於tax returns, W-2和Letter from each current employer and pay stubs, 我們都已經準備好了, 是不是就夠了? 我還一定得填個I-864給他們嗎?
