8 老師， 您好！我有幾個關於H1b  transfer 的問題想向您請教。 我查過以前的帖子，您幫助解答過類似的問題，但因為挺不容易找到這個新的工作， 不想出錯， 所以麻煩您幫忙看一下:

我的情況是：我前一陣被layoff，公司給了一個多月時間通知我，說在5月初的時候會withdraw 我的H1B. 因為一直沒有找到工作， 我在layoff date （5月初）之前一周交了I-539 申請轉B2, 已經收到了receipt。 現在有一家公司給了offer，準備辦H1B transfer。我的問題是：

1. 因為從layoff date  到 現在有兩周，是不是必須要告訴公司的律師我的B2 的申請，給他我的receipt number?-Not necessary, but it does not matter. 這個在我的H1B transfer 的申請中有什麽作用？-If your B-2 is approved after the H-1 approval, then your B-2 will override the H-1, thus you need to go to China to get the H-1 visa to come back.
2. 如果公司用了premium processing service， 而且USCIS 批準了H1b transfer， 並給了I-94,是不是我就不用出境，拿到H1B 的那天就可以開始工作了？-Right. But if your B-2 is approved later,, then see above.
3. 連接上個問題，如果我拿到了I-94, 不出境，我是不是要馬上遞交withdraw B2 的申請？-Beucase it is very short time (within 30 days) for you to find a new job after your layoff, you may just withdraw the B-2 application after you file H-1 using premium processing in case the B-2 approval override your H-1 approval. 這個過程是怎麽樣的呢？- Write a letter to request withdrawal of B-2 (provide the coy of the B-2 receipt notice). 我查了一下，好象我需要寫封信說明情況，還有withdraw也需要一段時間。現在網上說轉B2有很長時間的pending， 是不是withdraw 的審批要快一些？大概需要多久呢？如果在B2 approve 之前withdraw 了，是不是目前就沒有什麽問題了？ 但因為withdraw 了b2， 從我的layoff date  到 收到h1b transfer的receipt number  或是approval（即使用premium processing service, 是不是也應該先有個receipt-Yes.,還是直接15天就告訴結果？）， 就是空窗期，以後申請綠卡或其他簽證就會有麻煩？-No.
4. 如果USCIS 沒有給I-94, 我是不是就要出境?-Yes.那我B2 申請會怎麽樣，我需要做什麽?-Withdraw it or it will be void automatically after you leave US.
