我的情況有點複雜, 身份基本情況: H1B明年5月底到期(用完6年), PERM申請材料已經準備了一年多了還沒提交.
公司最近換了一位移民律師, 新律師在審核我的材料的時候發現上一位律師沒有put swa job order, 律師目前給出的解決方案就是整個PERM申請材料重做, 最快也得3個月才能file perm. 我的H1B也隻能等到140批下來再延期. 請問老師們, 除了公司律師給出的解決方案, 還有別的可行的方法嗎? 謝謝!
-Your lawyer knows your case well, and may just follow the lawyer's suggestion. If your PERM is still pending before April 2017, I suggest you to take a vacation (pay or unpay leave) and travel to China bebore/in April 2017 to stop your 6-year H-1B clock. Thus, once your PERM is approved, then use premium to get the I-140 approved in 15 days, and then ask the employer to file H-1B extension for you to extend your H-1b beyond your 6-year H-1 limit (use premium processing also). Then, you can use the H-1 approval notice to apply for the H-1 visa to come back.
