您好。我把您提供的immihelp 鏈接給新學校了, 但是international office 的人還在堅持讓我用EAD。
-Probably they want to save money. You should have not told them that you have filed I-485 when the school offered you the job.

- 使用EAD和H1b的不同就是如果日後綠卡遭拒,EAD就失效,而H1b不受影響。對嗎?-Correct.
- 如果使用EAD,那我暑期這三個月可以合法待在美國嗎?-Yes. Your pending I-485 allows you to stay in US legally even if you don't have a legal status (e.g. H-1, etc.).(因為是學校,現工作5月底結束,新工作8月初開始)
- 如果在暑期三個月內收到RFE for my employment status,我該如何答複呢?-Just provide your new job offer letter and it is enough.
- 我的EAD有效期至17年2月,可以renew嗎?-Yes. 應該什麽時候申請?-You can file renewal application in advance up to 120 days before your current EAD expires. 我自己申請,還是需要雇主申請?-You do it and it is irrelevant to thew employer. By the way, there is not I-765 filing fee for your EAD renewal (it is free).
- 我可以自己找律師辦H1b transfer 嗎?-No unless the HR agrees.
- 有沒有好的建議讓我說服學校international office呢?他們現在的借口就是以前曾經有過這樣的經曆,這三個月的gap會影響H1b transfer。-Just tell them that if the H-1 tasnfer approval has I-94, you can stay in US to work for them with H-1 status. If the H-1 ttransfer has no I-94, then you will go to China to get the H-1 visa to come back to work with H-1 status.
