PERM在request for reconsideration之後仍舊被拒，律師建議在request for review with BALCA的同時，讓同一家公司給我新辦一個different position的perm。

請問這樣可行嗎？

-Your employer can not have two pending PERM applications at the same period of time, so if the employer request for review with BALCA (equal the PERM is pending), then the second new PERM may not be allowed. So, talk to your lawyer about this.

如何界定different？

-The responsibilites should be significantly different between the two PERM position. Talk to your lawyer.
