B轉F1的申請最近被拒，原因是開學日期（2016年1月10日）距離舊I94過期日（2015年8月底）超過一個月。本來是想申請2015年8月份入學的（有證據），但是導師說I-539平均處理時間5個月以上（實際用了7個月），建議申請下個學期入學。能否就I-539實際處理時間太長file motion to reopen?
-I don't think you will win the motion to reopen (MTR). If you lose it, then your unlawful presence will be counted from the date your change of status (I-539) was denied, thus it will put you in big trouble. So, my suggestion is that you had better leave US as long as possible and get the F-1 visa in China to come back.
