Can I consult you? My husband's green card application at Guangzhou, China has been refused and the reason is that he is a Communist party member (共產黨員). WE have waited since May 2013.
-Your spouse should have written a statement addressing that the purpose of his joining the Party was for employment and promotion, etc. Many Chinese Communist Party members got green card by just providing this kind of statement.
Now, they suggest that my husband can apply for waiver at USCIS.
In our thinking, can my husband apply for B2 visa in China in his current status of green card refusal?
-Probably the B-2 visa will be denied due to immigtration intent, but he may try to see what happen (it does not hurt him to try, anyway).
If he can't apply for B2, would you kindly provide us the information on how to apply for waiver at USCIS?
