我們是加拿大公民，我H1B，剛剛收到通知綠卡寄出來了，沒想到這麽快。我先生一直是H4往返中國美國，沒有跟我一起申請485. 他目前在中國，十一月回來。

我的問題是

1. 他這回以什麽身份入境美國？

-He can not enter US using H-4 visa anymore, but he can enter US using B-2 visa (if he is also a Canadian citizen, he can just use the passort to enter US, not need a visa).

2. 他申請綠卡是走親屬移民從I-130開始嗎？看您的文章說“隻有在你的配偶在婚前就拿到了綠卡，你才
歸屬親屬移民類“。

-No. He can file I-485 any time if he is physically present in US as long as your priority date is current (he had better file I-485 after he enters US for 3 months or more later in this case). Or you file I-824 for him to apply for an immigtration visa in China or Canada (if he is a Canadian citizen) by following-to-join.

3. 如果他不申請綠卡，能以旅遊簽證往返嗎？

-Yes.
