1. 關於EAD申請: 因為我現在找工作已基本有了眉目, 迫切需要工卡能及時到手(八月底之前). 為了保險起見, 我是否需要在申請這個綠卡的EAD的同時, 也試著申請作為H4的EAD(五月底開始受理), 來個雙保險? 這樣的話, 想知道一下:
兩個一起申請是否更加牢靠, 還是實際上沒任何幫助, 還是會相互影響, 反而壞事?
-USCIS will only approve one application, and deny another if you file taw EAD applications at the same period of time. By the way, there is not fee for I-485 based EAD application, but you need to pay the I-765 filing fee for H-4 based EAD application.
2. 我太太作為H1B主申請人將不申請EAD以免節外生枝, 但她的I485批準是否會影響我的EAD批準, 也就是說, 到file I485時, 我倆的申請是不是開始完全分開對待還是我還是完全依附於她(包括EAD)直到Green Card真正拿到為止?
-Your EAD is irrelevant to her case, but her I-485 has to be approved first, then your I-485 is approved later; or both I-485s are approved at the same time.
3. I134: 我們的通道是EB2 PERM, 是否有必要填I134或I864? 我有同學跟我們情況一樣, 但當年填了I134表, 但這次我左看右看I485及I134的instruction及網上的討論, 發現I134或I864好像根本用不著填, 想向您確認一下.
-Not need any.
是不是隻要employment letter就已經足夠了?
-Yes.
是否還要最近三年的W2或IRS的tax transcript或最近三個月的paystubs?
-No.
4. 複印件和原件: 這事我前段時間問過您, 就是有關criminal history的文件是否要寄原件, 您的回答是複印件就行. 但我後來又仔細讀了I485有關Initial Evidence: 1. Criminal history: A-D的詳細解釋, 發現都要求original or court-certified copy (別的文件倒的確基本是複印件就行).
-Then, you may provide the original one, and keep the photocopy of your personal record.
現在我已拿到一封從DA Office發出的官方信件詳細解釋我arrest後處理過程(have not been charged, and will not be charged if I complete DPP successfully), 及一些別的supporting documentation(詳見我以前的帖子).
是否這封信我最好寄original, 別的supporting就用copy算了?

5. VISA number/entry/日期: 我有新舊兩本護照, 新護照在我拿到後從未使用它出入美國, 沒有一個圖章, 而作廢的老護照上有我所有出入美國的信息, 包括去兩次Canada和一次Bahamas的, 都在回來時因去的是adjacent country和island都未申請入美簽證直接入境.
這樣的話, 我是否需要複印新舊兩本護照,

並在Nonimmigrant Visa Number&Consulate Where Visa Was Issued&Date Visa Issued處用我最後一次的在中國獲得的簽證信息(比去Canada&Bahamas早),

-Yes, the last entry was the one she got the I-94 at the port of entry when entering US . Do the same way for your I-485.
7. 我太太的I94 Number每次改或延簽證後都發生改變, 填Part. 1: I-94 Number(還有I765 Item10)是不是以最近一個為準?
-Yes, it is the current valid I-94 (not expire yet).
8. 我現在沒工作一直在家, current occupation是填unemployed, 還是填homemaker?
-Put "unemployment".
9. 女兒出生在美國, 查了她的美國護照, 隻有護照號和SSN, 她是不是根本就沒有A #, 這樣填Part3. B.親屬時可以跳過A#?
-leave it blank or put "N/A".

10. Part 3.1. Date of Intended Departure & Excepted Length of Trip: 現無具體回國計劃, 這兩個空如何填最好?
-Estimate a departure date after 3 months or later and length (e.g. 6 months, etc.) there.
11. Part 4.1.b. List the countries you intend to visit: 現無具體打算, 但很可能去Canada, 是否填了國家不去也可以?
-It does not matter. You can go or not go to any country.

12. 我用過OPT一年, 拿過兩個EAD, 填11. Date時填最早的還是最晚的?
-the latest one.
13. 同時遞交I485 & I131 & I765時, 很多supporting document是重複的, 我是否需要遞交一份就夠了,
