I was rejected as EA a couple of months ago.
My friend told me that immigration officers no longer ask the request for additional evidence. Instead, they either approve or deny your case. Currently, appeal is treated as request for additional evidence, which means that you have great chance to win.
While the time is limited, you have to prepare more evidence in short time.
I send appeal as well as Motion to Reopen at the same time. Frankly speaking, I did not get enough evidence to fight back. The reason is that some lawyers said that it is not worthy trying, their comments made me hesitate, give up or fight back. It was just waste of time, and it turns out that many lawyers are wrong.
The chance to win the appeal is much higher nowadays than it used to be.
