人不在美國，有approved EB1A I140,要通過consular processing 申請一個移民簽證E1 visa.
-Do you apply for E-1 visa? E-1 visa is for treaty traders, and it is irrelevant to EB-1A.

移民局網站上對E1 visa Persons with extraordinary ability的介紹中提到“Such applicants do not have to have specific job offers”

但是visa申請指南中又要求E類visa的申請人提供“A job offer letter from the petitioning company”,目的是“demonstrates you ... are not likely to become public charges after immigrating to the United States.”

問題是EB1A的的petitioner是我自己，根本就沒有petitioning company，更沒有offer letter了。

我該咋辦呢？

是隨便通過skype麵試幾個美國公司，拿個offer，簽證麵試的時候帶上。問題是我人都不在美國，根本無法onsite，可能拿不到offer。

還是直接把移民局網站上對E1 visa的介紹打印下來說明我這個類別不需要job offer?
-The EB-1A I-140 (or NIW I-140) is self-sponsored, which does not required an employer. I have not found whether the job offer letter or employment is needed for EB-1A I-140 based I-485 or immigration visa application by law, but practically, most US immigration officers require the applicant to have a job offer or is employed before the I-485 or immigration visa is approved. So, if they ask you to provide it, you may have to follow their requirements because it is difficult to argue it with them. Of course, some officers may not require it, then you may be fine not to provide it.
