H1B簽證，I-140 已批準，I-485尚未遞交，現在在轉工作，新公司答應幫助轉簽證並遞交新的I-140，priority date 應該不會丟失。我的問題是：如果11月轉簽證成功，可以11月底就從老公司辭職，12月修整一個月，1月再去新公司上班嗎？感覺比較累，想休息一下再上班，不知是否合法。
-You may ask your new employer files H-1 transfer on Later in the early next month (not use premium process), then you can take December off, and work in Jan. for the new employer. You are legal to stay home or work for the new employer during the H-1 transfer pending (not need to wait for H-1 transfer approval to work for the new employer).
