之前帖子8老師說可以上庭一試，今天我的律師說隻要WOM就行，不需要我上庭，我想再跟您確認一下，
-WOM is one type of lawsuit against USCIS. You may suggest follow the lawyer's suggestion to see what will happen. If it fails, you still can file another type of lawsuit.

另外有什麽重點需要跟律師提點。因為如果不上庭，什麽機會能跟法官申請自願離境和3years bar的豁免？
-Unless the immigration judge put you in removal proceedings (deportation), you don't need to do anything to the judge and just stay in US until your spouse get the US citizenship to sponsor your green card if your lawsuit does not work.
