-Has the H-4 holder filed the H-4 extension together with the H-1 extension? If yes, then the H-4 holder can stay in US legally during the H-4 extension pending. Otherwise, the H-4 holder needs to leave US after the H-4 I-94 expires, and then apply for the H-4 visa to enter US after the H-1 extension is approved.
