What you said is true. But your answer  is not for the question the lady asked. So, both of us are right.

The lady has J-1 history and she is subjected to two year home resident requirement in China and she does not get the J-1 waiver yet. She wants to know whether she can get the H-1 if she becomes a Canadian even if she does not get the J-1 waiver or stay in China for two years. Obviously, the answer is" No" no matter whether she is a Canadian or not in this case.
