回複：請教老師，EB2 485 Pending 等排期，如果加入新公司，可以申請EB3嗎？

When your new employer files EB-3 for you, the new EB-3 I-140 is irrelevant to your existing EB-2, but it may use the earlier PD of EB-2.  You may still use I-485 which was filed based on EB-2 I-140, with no action on your side.


 

1）可以在老公司EB2 485 上直接申請新公司EB3的140嗎？需要老公司同意提供某種文件嗎？

2）如果新公司同意申請EB3的140，那麽EB2也能Port 到新公司嗎？（工作類似）？

3）新公司薪水如果滿足EB2標準的話，能申請上述EB3嗎？
