I sent an email to lawyer and CLEARLY stated that I ask her to use the cover sheet I provided (copy and pasted from your post). I even fill out the information needed for her. She replied and indicate that she is not going to use it, as she does not require anything from me. She said the filing 140 without original PERM is a standard procedure (hence no futher document or anything is needed from me),
she will request USCIS to ask a duplicate from DOL though.
-As long as she request USCIS to get the duplicate from DOL, that will be fine. So, you don't need to worry about it.
However, I noticed that on the I-140 form has a question, Page 3, Part 4, Item 8, "If the petition is being filed without an original labor certification, are you requesting that USCIS request a duplicate labor certification from the Department of Labor?" Given the situation, now the response should change from "No" to "Yes". On the left side of the same page, I filled out my name and foreign mailing address in Native Alphabet by Hand Writing. She did not even ask me to re-fill those sections, I suspect that she was not even planning to change the response to that question on the face of I-140. I am seriously doubting that she is going to properly prepare the filing for me or her ability to file properly.
8 laoshi, I emailed her about my concern of not changing the response on Item8, I don't know what else I can do. What should I do?
