我現在是學校的那種non-cap的h1b，老板馬上沒錢，到明年2月底。如果我現在找公司，是不是已經沒有capped h1b的名額了？-Right.

可是聽說4月份發放的名額，要10月份才能生效，這期間我是沒辦法工作？-If you can work for the school until April to keep your H-1 status valid, then you can do H-1 transfer to the company to work for the company after you file the H-1 petition in April or later.
But if you lose your job before April, you are out of status and can not work for the company until Oct. 1, 2014 if you get the H-1 later (you need to get the H-1 visa in China to come back to work beginning on Oct. 1 in this case).
聽說去年還是前年出台了一個新的規定，如果一個人有學校的h1b，就可以申公司的h1b，公司的h1b沒批下來前，可以合法工作？-Yes, but you need to work for the school and the company at the same time (either full-time or part-time for the school).
那公司的h1b批下來前，我的學校的h1b肯定失效了（離開崗位就會失效吧），這樣在等待新h1b期間也能工作嗎？-No.
還是完全理解錯了？
